1. NATURE AND APPLICABILITY OF TERMS

These Terms constitute a legally binding agreement between you and Oncare under the Indian Contract Act, 1872.

  • The Information Technology Act, 2000 and the rules made thereunder
  • The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, as amended

  • Other applicable healthcare, data protection, and consumer laws in India
  • Where relevant, applicable international data protection laws such as the General Data Protection Regulation (EU) 2016/679 (GDPR)

Oncare reserves the right to modify these Terms at any time. Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms.

2. ABOUT ONCARE AND SCOPE OF SERVICES

Oncare Cancer Centre is operated by Aedos Health Solutions Pvt Ltd and provides oncology and related healthcare services through its employed medical professionals and consultant/visiting doctors.

The Website is intended to:

  • Provide general information about Oncare and its Services; and
  • Allow Users to submit requests for appointments, consultations, or related Services.

Oncare does not accept payments through the Website unless expressly stated otherwise. Submission of a request does not guarantee confirmation of any appointment or Service.

3. ELIGIBILITY

You must be at least 18 years of age and legally competent to enter into a contract under applicable law to use the Website. If you are using the Website on behalf of a minor or another person, you represent that you are legally authorized to do so.

4. ACCEPTANCE OF TERMS

5. NATURE OF MEDICAL SERVICES AND DISCLAIMER ON OUTCOMES

Oncare provides healthcare services through qualified medical professionals, including doctors employed by Oncare and consultant/visiting doctors. You expressly acknowledge and agree that:

  • Medicine is not an exact science and medical outcomes vary from patient to patient.
  • Oncare does not guarantee any specific results, recovery, cure, or outcomes.
  • Treatment decisions and clinical judgment are taken by the treating medical professionals based on the patient's condition and medical history.
  • To the maximum extent permitted by applicable law, Oncare shall not be responsible or liable for treatment outcomes, complications, or lack of expected results.
  • Nothing on the Website or communicated by Oncare shall be construed as a guarantee, warranty, or assurance of any medical outcome.
  • All content on the Website is for general informational purposes only and does not replace in-person medical consultation, diagnosis, or treatment.

In case of a medical emergency, you should contact the nearest hospital or emergency services immediately.

6. APPOINTMENTS AND SERVICE REQUESTS
  • Submitting a request through the Website does not constitute confirmation of an appointment or Service.
  • Appointments and Services are subject to availability of doctors, facilities, and clinical or operational considerations.
  • Oncare reserves the right to reschedule or cancel appointments due to medical, operational, or unforeseen circumstances.
  • Oncare shall not be liable for any inconvenience caused due to rescheduling, delays, or non-availability of a particular doctor or Service.

Any fees, cancellations, refunds, or no-show policies shall be governed by the applicable policy of the relevant Oncare center or treating facility.

7. PERSONAL DATA, HEALTH DATA AND PRIVACY

Oncare collects, stores, processes, and uses personal data, including sensitive personal data and health data, in accordance with applicable law, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and, where applicable, the GDPR and other international data protection laws, and in accordance with its Privacy Policy.

By using the Website and/or availing Services, you expressly consent to the collection, storage, processing, and sharing of such data with treating doctors (including employed and consultant doctors), laboratories, diagnostic centers, and other partners involved in your care, as permitted by applicable law.

Your Rights: Subject to applicable law, you may have the right to:

  • Access your personal data
  • Correct or update your personal data
  • Request erasure or restriction of processing
  • Withdraw consent, where processing is based on consent
  • Lodge a complaint with the Grievance Officer or relevant authority

Oncare shall not be responsible for the accuracy or completeness of information provided by the User.

The Website may use cookies and similar technologies in accordance with applicable law and the Cookie Policy to enhance user experience, analyze usage, and improve services.

  • (b) is unlawful, harmful, defamatory, obscene, or otherwise objectionable;
  • (c) infringes any intellectual property or proprietary rights;
  • (d) violates any law for the time being in force; or
  • (e) threatens public order or national security.

Oncare reserves the right to remove or disable access to such information and to suspend or terminate access in accordance with applicable law.

21. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy & Cookie Policy constitute the entire agreement between you and Oncare regarding the use of the Website and Services.
